Terms and Conditions of Sale – TudoPesca

All purchase and sale contracts concluded through the TudoPesca website are governed by these Terms and Conditions.

2. Purpose

These Terms regulate the sale of products marketed by TudoPesca through its online store.

3. Ordering Process

The Customer may place an order through the website by adding products to the shopping cart.

After clicking “Checkout”, the Customer must enter their details, select the payment and delivery method, and a summary of the order will be presented.

By clicking “Confirm Order”, the Customer submits a binding purchase proposal.

After submission, an automatic email confirming receipt of the order will be sent.

All orders are subject to stock availability.

In case of unavailability, the Customer will be informed and may choose to cancel with a full refund.

4. Prices

The prices presented:

Are indicated in euros (€)
Include VAT at the legal rate in force
May be changed without prior notice

Only transport costs, when applicable, are added to the order value.

Pricing error:
In case of a technical, system, or human error resulting in a clearly incorrect price, TudoPesca reserves the right to cancel the order, with a full refund to the customer.

5. Minimum Order Value and Quantity

Minimum quantities may be applied per product
6. Shipping Costs
Mainland Portugal
Free shipping for orders ≥ €69
For lower values, the cost is shown at checkout
Azores and Madeira
Free shipping for orders ≥ €120
For lower values, cost calculated automatically at checkout according to weight and destination
International Shipping
Costs calculated automatically according to destination and weight
Presented before order confirmation

No additional handling fees are charged.

7. Delivery Times

Delivery times are estimated and may vary due to logistical reasons.

Mainland Portugal: 24 to 48 business hours
Azores and Madeira: 3 to 7 business days (up to 10 in exceptional cases)
Europe: 2 to 7 business days
Other destinations: upon request

When an order includes products with different delivery times, the longest timeframe will prevail.

8. Transport and Risk

Orders are shipped by carriers selected by TudoPesca.

The risk of loss or damage is transferred to the consumer at the time of delivery.

9. Payment Conditions

The following payment methods are available:

Bank transfer
Multibanco
MB Way
Bank card
Other methods available at checkout

Shipment only occurs after payment confirmation.

10. Warranty

All products are covered by a 3-year legal warranty, under Decree-Law no. 84/2021.

The warranty applies exclusively to final consumers.

The Customer must check the order upon delivery and report any issues.

11. Right of Withdrawal

Under Decree-Law no. 24/2014, the Customer has 14 days after receipt to withdraw from the contract.

To do so:

Must communicate the intention to return
Bears the return costs

The product must be returned:

In good condition
With original packaging
Without signs of use beyond simple verification of its nature, characteristics, and functioning

Personalized products are excluded.

12. Returns and Defective Products

In case of defect:

The Customer must notify by email with description and, if possible, images
After validation, a replacement or refund will be issued

In these cases, all costs are borne by TudoPesca.

13. Refunds

The refund will be made within a maximum of 14 days after receipt and verification of the returned product.

The same payment method will be used, unless otherwise agreed.

14. Alternative Dispute Resolution

Under Law no. 144/2015, the Customer may resort to:

15. Applicable Law and Jurisdiction

These Terms are governed by Portuguese law.

For dispute resolution, the court of the District of Portimão shall have jurisdiction, with express waiver of any other.
